General Terms and Conditions of Sale

1. Introduction

These General Terms and Conditions of Sale govern all services (the Services) provided by Suzana Pimenta, a sole proprietorship based in Pully, Switzerland, hereinafter referred to as “Suzana Pimenta”, “we” or “our”, to its clients, hereinafter referred to as “you” or the “client”. The Services include, in particular, image consulting for individuals (women, men and teenagers) and businesses, personal shopper services, VIP and artist support, as well as workshops, conferences and gift vouchers. Before using the Suzana Pimenta website (www.suzanapimenta.ch) and the associated pages (the “Site”) and/or booking a Service, we invite you to carefully read all provisions of these General Terms and Conditions of Sale as well as the Privacy Policy, the Terms of Use of the Site and any other provisions that may appear on the Site in connection with promotions or specific campaigns.

Each Service booked with Suzana Pimenta is governed by these General Terms and Conditions of Sale. Unless otherwise stated in these General Terms and Conditions of Sale, they apply to the exclusion of all other terms and conditions. These General Terms and Conditions of Sale do not apply to online courses, which are exclusively governed by the general terms and conditions of Hotmart (see article 2 below).

Our General Terms and Conditions of Sale may be amended upon publication of a new version on the Site at a more recent date. We invite you to read our General Terms and Conditions of Sale regularly to stay informed of such amendments. The General Terms and Conditions of Sale that apply are those in force at the time you book a Service, unless an amendment thereto is required by law or a governmental authority (in which case, such amendment shall apply to bookings previously made by you).

The Services are in principle provided in Switzerland. Engagements abroad may be agreed on a case-by-case basis.

2. Online courses – Hotmart platform

The online courses presented on the Site are not sold by Suzana Pimenta. They are marketed and provided through a third-party provider, the Hotmart platform, operated by Hotmart B.V., a company incorporated under Dutch law with its registered office in Amsterdam, the Netherlands, or by any other entity of the Hotmart group designated in its general terms and conditions (Hotmart). By clicking on the corresponding purchase links on the Site, you leave the Site and are redirected to the Hotmart platform.

The contract for the purchase of and access to an online course is entered into exclusively between you and Hotmart, to the exclusion of Suzana Pimenta. Only the general terms and conditions of Hotmart, which you accept during the ordering process on the Hotmart platform and which are available at www.hotmart.com, apply to such purchase, in particular with regard to the conclusion of the contract, the price, payment terms, access to the course, any refund guarantees and the processing of your payment data.

Any question or complaint relating to payment, refund or access to the online courses must be addressed directly to Hotmart. Suzana Pimenta is not a party to the contract entered into with Hotmart and disclaims, to the extent permitted by mandatory applicable law, any liability with regard to the operation of the Hotmart platform and the performance by Hotmart of its obligations.

3. Booking and conclusion of the contract

Services may be booked by means of the contact form available on the Site, by email at the address info@suzanapimenta.ch, by telephone, or by any other agreed means. Upon request, a quotation or a description of the Service will be provided to you before the booking.

Any booking becomes effective, and the contract is concluded, upon written confirmation (an email being sufficient) from Suzana Pimenta and, where applicable, upon receipt of the payment or deposit requested.

Services are reserved for persons of legal age having full legal capacity. Services intended for minors, in particular teenagers, must be booked by their legal representative. If you book a Service on behalf of a legal entity, you confirm that you are authorised to do so.

The information you provide at the time of booking must be accurate and up to date. Please inform us without delay of any change to your contact details or any other relevant information, so that we have accurate data to process your requests and bookings.

4. Prices

The prices of the Services are those communicated on the Site, in the quotation or in the booking confirmation, in Swiss francs (CHF), at the time of booking, inclusive of any applicable taxes.

Unless otherwise stated, prices do not include any additional costs related to the performance of the Service, in particular travel expenses, which will be communicated to you in advance and invoiced separately. Purchases of clothing, accessories, or any other items or products, as well as third-party services (hairdressing, beauty treatments, etc.) made in connection with a Service, in particular personal shopping, remain at your sole expense.

Suzana Pimenta reserves the right to modify its prices in the future. Price modifications shall not apply to Services already confirmed.

5. Payment

Depending on the terms communicated at the time of booking, payment is made in advance, upon completion of the Service or upon invoice. Unless otherwise agreed, invoices are payable within the period indicated thereon or, failing that, within thirty (30) days of receipt.

Payment may be made by bank transfer or by any other payment method accepted by Suzana Pimenta and communicated at the time of booking.

Suzana Pimenta reserves the right to make the provision of a Service conditional upon prior payment of all or part of the price, and to refuse any new booking as long as an outstanding balance has not been paid in full.

6. Gift vouchers

Gift vouchers for an amount chosen by the client may be ordered from Suzana Pimenta. They are payable in advance and may be used for the Services indicated thereon, in particular image consulting and personal shopper services.

Unless otherwise stated on the voucher, gift vouchers are valid for the period indicated thereon from the date of issue. Gift vouchers may not be refunded or exchanged for cash, even partially. Suzana Pimenta disclaims any liability in the event of loss, theft or misuse of a gift voucher.

7. Performance of the Services, cancellation and rescheduling

The dates, times and locations for the performance of the Services are agreed upon mutually at the time of booking. Suzana Pimenta may contact you by SMS, WhatsApp, telephone and/or email to provide you with information regarding your booking and its progress.

Any request for cancellation or rescheduling of a Service must be communicated in writing as soon as possible. Amounts already paid may be carried over to a new Service date, subject to availability and agreement between the parties.

In the event of a cancellation or rescheduling request communicated less than forty-eight (48) hours before the agreed appointment, of an unannounced absence or of a no-show at the appointment, all or part of the agreed price, but no more than the full amount thereof, may be invoiced or, as the case may be, retained as compensation.

If Suzana Pimenta is unable to perform a Service on the agreed date, in particular due to illness or accident, a new date will be proposed to you. Failing agreement on a new date, the amounts already paid for the relevant Service will be refunded to you, to the exclusion of any other compensation.

8. Nature of the Services

The advice and recommendations provided in the context of the Services are based on the professional expertise of Suzana Pimenta and are strictly personalised in nature. Suzana Pimenta undertakes to perform the Services with all due care required by the circumstances; its obligations constitute an obligation of means and not an obligation of result.

The proper performance of the Services also depends on your cooperation. You undertake to provide Suzana Pimenta with accurate and complete information useful for the preparation and performance of the Services.

Purchases of clothing, accessories or other items made in connection with a Service, as well as third-party services (hairdressers, beauticians, cobblers, etc.), are entered into directly between you and the relevant retailers or service providers. Suzana Pimenta is not a party to these contracts and assumes no liability in connection therewith, in particular with regard to the quality, exchange or return of items purchased or the quality of services provided.

9. Intellectual property

Course materials, documents, guides, presentations, written recommendations and other content provided in the context of the Services, as well as all content published by Suzana Pimenta on the Site, social media (Instagram, Facebook, etc.), YouTube and any other online platform, remain the exclusive property of Suzana Pimenta. They are intended for your personal use only. Any reproduction, dissemination, disclosure to third parties or use for other purposes, in whole or in part, without the prior written authorisation of Suzana Pimenta is prohibited, with the exception of sharing by means of the built-in features of the relevant platforms (such as sharing or embedding buttons).

10. Liability

The photographs and texts presented for illustration and description of the Services on the Site are non-contractual and provided for informational purposes only. Suzana Pimenta cannot be held liable for any errors or omissions in the illustrations or texts displayed on the Site.

Without limiting the scope of these General Terms and Conditions of Sale and to the extent permitted by mandatory applicable law, you expressly acknowledge and accept that we shall not be liable for any direct or indirect, incidental or consequential damage of any nature whatsoever (even if the threat of such damage was known or should have been known to Suzana Pimenta), including, among others, loss of profit, loss of enjoyment, loss of data or other intangible losses that may arise from (i) the performance or inability to perform the Services, (ii) the information and indications presented on the Site regarding the Services, or (iii) any other cause related to the Services. In any event, no claim of any kind shall exceed an amount equivalent to the price of the relevant Service(s).

These General Terms and Conditions of Sale do not contain any provision excluding or limiting our liability in the event of fraud or gross negligence.

11. Force majeure

Suzana Pimenta will make every effort to fulfil its obligations. However, Suzana Pimenta shall not be held liable for delays or failure to perform the Services caused by circumstances beyond its reasonable control (“force majeure”). Such circumstances include, without limitation, strikes and industrial action, riots, revolts, wars, epidemics, pandemics, natural disasters or any other situation that renders the performance of the Services impossible or impracticable.

In the event of a delay resulting from a force majeure event, Suzana Pimenta’s obligations shall be suspended and the time for performance of our obligations shall be extended for the duration of the event. Suzana Pimenta will fulfil its obligations as promptly as reasonably possible. In the event of a definitive impossibility to perform the booked Service due to a force majeure event, the booking shall be cancelled and the price and costs already paid shall be refunded as soon as possible.

12. Miscellaneous

These General Terms and Conditions of Sale constitute the entire agreement between Suzana Pimenta and you with respect to the provision of the Services. All other provisions set out by Suzana Pimenta governing its relationship with you, in particular with regard to the use of the Site and our Privacy Policy, supplement the General Terms and Conditions of Sale. In the event of a conflict between them, these General Terms and Conditions of Sale shall prevail.

If any provision of the General Terms and Conditions of Sale is found to be null or unenforceable for any reason or legal cause whatsoever, the parties agree that their intentions, as reflected in the invalid provision, shall be given effect to the fullest extent possible and that the remaining provisions of the General Terms and Conditions of Sale shall remain in full force and effect.

You may not assign or transfer any of your rights or obligations under these General Terms and Conditions of Sale. We may assign or transfer any right or obligation, or subcontract the performance of any of our obligations under these General Terms and Conditions of Sale to any third party at any time, without being required to obtain your prior consent.

Any tolerance or forbearance on the part of Suzana Pimenta in the application of all or part of the clauses of these General Terms and Conditions of Sale, regardless of the frequency or duration thereof, shall not constitute a waiver of the right to enforce them.

You agree that any communication or transmission of information, including in particular the downloading of the General Terms and Conditions of Sale and the sending of booking confirmations, may validly be made in PDF format or by email.

The headings of the articles of the General Terms and Conditions of Sale are for indicative purposes only and shall not alter or modify the terms and conditions in any way.

13. Governing law and jurisdiction

These General Terms and Conditions of Sale and the Services are governed by and construed in accordance with the substantive laws of Switzerland exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods and without regard to conflict of laws provisions.

Any dispute or claim arising out of or in connection with these General Terms and Conditions of Sale shall be submitted to the exclusive jurisdiction of the courts of Lausanne, Switzerland, subject to any other mandatory forum.

1. Acceptance and amendment of the Terms of Use

Your access to and use of the Site are governed by these terms of use (the Terms of Use). By accessing, browsing and using the Site, you acknowledge that you have read, understood and accepted without reservation the Terms of Use, which we amend from time to time.

If we decide to amend our Terms of Use, we will upload the new version on the Site. We therefore invite you to consult these Terms of Use regularly to take note of any amendments.

2. Access to the Site

By using the Site, you confirm that you are at least 18 years of age and have full legal capacity. If you are a minor, you confirm that you access and use the Site with the prior consent of your legal representative.

If you use the Site or its features on behalf of a legal entity, you confirm that you are authorised to do so.

The equipment and materials (computer, software, telecommunications means, etc.) required to access the Site are at your sole expense, as are the telecommunications costs incurred by their use.

3. Copyright and intellectual property

The content of the Site and in particular, but not exclusively, the texts, trademarks, logos, graphics, photographs, videos, sounds, music, layouts, designs, know-how and methods, are the property of Suzana Pimenta or are used with the authorisation of their owners and as such are protected by their copyrights, trademarks or any other intellectual or industrial property rights recognised under the laws in force.

Subject to the provisions set out in article 4 below, no element of the Site may be construed as granting a licence or a right of use of any element presented on the Site.

4. Use of the Site

Subject to compliance with these Terms of Use, and within the limits specified herein, you are granted a revocable, non-exclusive, non-transferable and non-assignable right to access the Site and use its content, for your personal non-commercial use only.

You are thus authorised to download, display or print the content of the Site solely for personal, non-commercial use, while retaining and reproducing any copyright notice or other intellectual property notice included in the information or other materials you download. Suzana Pimenta does not warrant that your use of any element presented on the Site does not infringe the rights of any third party.

5. Information deemed non-confidential

All data and information that may personally identify you and that you transmit via the internet to the Site are protected and processed in accordance with our Privacy Policy. We invite you to read this Privacy Policy carefully before entrusting us with your data and information that may personally identify you.

Any other information or material that you communicate via the internet to Suzana Pimenta, by email or any other means, including data, questions, comments, suggestions, ideas, graphics, etc., will not be treated as confidential or proprietary. Everything you transmit or upload will become the property of Suzana Pimenta and may be used without restriction for any purpose. Such elements may in particular, but not exclusively, be reproduced, disclosed, transmitted, published, disseminated and uploaded. Specifically, Suzana Pimenta shall be free to use any ideas, concepts, know-how or techniques included in communications you send to the Site for any purpose, including in particular the development, promotion and marketing of services using such information. Any use of such information communicated by you shall be without remuneration to you or any third party.

By transmitting information, you warrant that the content transmitted is your property, that it is not defamatory and that its use by Suzana Pimenta will not violate the rights of any third party. Suzana Pimenta shall not be obliged to use the information transmitted.

6. Disclaimer of warranties

The photographs and texts presented for illustration and description of the services on the Site are non-contractual and provided for informational purposes only. Suzana Pimenta cannot be held liable for any errors or omissions in the illustrations or texts displayed on the Site.

Without limiting the scope of article 7 below, all material, information and everything you find on the Site are provided “as is”, on an availability basis, and without warranty of any kind, express or implied, including, among others, the implied warranty of merchantability or fitness for a particular purpose.

Suzana Pimenta does not warrant that the Site or its content will meet your expectations, that it will be uninterrupted, timely, secure or free from any error.

Any advice or information, obtained from Suzana Pimenta in written or oral form through or during the use of the Site, does not give rise to any warranty not expressly set out in these Terms of Use.

7. Limitation of liability

You access, use and browse the Site at your own risk.

You acknowledge and accept that, to the fullest extent permitted by applicable law, Suzana Pimenta or the companies that participated in the creation, production or maintenance of the Site shall not be held liable for any direct, indirect, incidental damage, or for compensation for moral prejudice, costs, losses, decrease in turnover or profits, or liabilities of any nature whatsoever (even if such damage was known or could have been foreseen by Suzana Pimenta), that may result from the use of or, conversely, the inability to use the Site or its content.

Any use of materials downloaded or otherwise obtained through the use of the Site is at your own risk. Suzana Pimenta assumes no liability for any damage or virus that may affect your computer or computer equipment as a result of accessing or using the Site or downloading elements from the Site, or for unlawful interference with computer systems.

Suzana Pimenta reserves the right to interrupt or suspend all or certain functions of the Site. Suzana Pimenta accepts no liability of any kind for any interruption or suspension of all or certain functions of the Site, whether resulting from acts or omissions of Suzana Pimenta or of a third party.

8. Modification of information

The content of the Site may include inaccuracies or errors. Suzana Pimenta reserves the right, at any time and without notice, to modify, correct or improve such content but shall not be held liable for such errors or inaccuracies.

9. Services and online courses

The Site presents the services offered by Suzana Pimenta, in particular in the areas of image consulting, personal shopper, VIP and artist support and corporate services (the Services). The related information is provided for indicative purposes and does not constitute a binding offer. The booking and provision of the Services are governed by our General Terms and Conditions of Sale.

The online courses presented on the Site are marketed and provided through a third-party provider, the Hotmart platform, operated by Hotmart B.V., a company incorporated under Dutch law with its registered office in Amsterdam, the Netherlands, or by any other entity of the Hotmart group designated in its general terms and conditions (Hotmart). By clicking on the corresponding purchase links on the Site, you leave the Site and are redirected to the Hotmart platform.

The contract for the purchase of and access to an online course is entered into exclusively between you and Hotmart, to the exclusion of Suzana Pimenta. Only the general terms and conditions of Hotmart, available at www.hotmart.com and accepted during the ordering process on the Hotmart platform, apply to such purchase, in particular with regard to the conclusion of the contract, the price, payment, access to the course, any refund guarantees and the processing of your payment data. Suzana Pimenta is not a party to this contract and disclaims any liability with regard to the operation of the Hotmart platform and the performance by Hotmart of its obligations.

10. Links

As a service to our visitors, the Site may contain hyperlinks to other websites that are neither operated nor controlled by Suzana Pimenta. Suzana Pimenta cannot be held responsible for such websites and disclaims any liability with regard to their content, legality, accuracy or functionality.

The creation of any hyperlink to the Site is prohibited without the prior written consent of Suzana Pimenta.

11. Non-compliance

Without limiting the rights set out elsewhere, we reserve the right to deny you access to the Site or to refuse to provide the Services presented thereon in the event of non-compliance with these Terms of Use.

12. Miscellaneous

These Terms of Use constitute the entire agreement between Suzana Pimenta and you with respect to the access to and use of the Site and its content. All other provisions set out by Suzana Pimenta governing its relationship with you, in particular with regard to the provision of the Services and our Privacy Policy, supplement the Terms of Use. In the event of a conflict between them, the other provisions shall prevail.

If any provision of these Terms of Use is found to be null or unenforceable, the parties agree that their intentions, as reflected in the invalid provision, shall be given effect to the fullest extent possible and that the remaining provisions of the Terms of Use shall remain in full force and effect.

Privacy Policy

Your privacy matters to us. As data controller, Suzana Pimenta undertakes to process the personal data you provide to us in a transparent manner and in compliance with applicable law.

Suzana Pimenta, hereinafter “we” or “our”, is a sole proprietorship based in Pully, Switzerland. The following guidelines apply to all data you provide to Suzana Pimenta.

This privacy policy (the Policy) is dated July 2026. It may be revised at regular intervals (see article 11).

By accessing the website www.suzanapimenta.ch (the Site), which we operate, you expressly agree that we process your data in accordance with the Policy.

1. What is personal data?

Personal data means any data that relates to an individual (the Data). Such Data may either allow you to be identified directly (for example your first and last name or your email address) or indirectly by cross-referencing various information about you (for example the IP address of your computer or your telephone number).

2. What type of Data do you provide to us?

The Data that we collect automatically when you access the Site or that you voluntarily provide to us, in particular by means of the contact form on the Site, when booking a service or when ordering a gift voucher, are as follows (fields preceded by an asterisk are required and additional fields may be provided at the user’s discretion, on an optional basis):

*your surname;
*your first name;
if applicable, the name or corporate name of the company you represent;
*your email address;
your telephone number or WhatsApp number, as applicable;
the type of service you are looking for;
any personal information you spontaneously provide to us during email exchanges or in the context of the preparation and performance of the services (for example your photographs, your clothing preferences or your image objectives);
*technical data collected during the use of the Site (technical logs, digital footprints, information on the security and use of the device, IP address);
technical data processed by the Google reCAPTCHA service, which loads on all pages of the Site, for the purpose of protecting the Site against automated submissions (spam) when using the contact form;
the Data collected by the Site’s cookies, as described in article 10 of the Policy (in particular consent preferences, the chosen language, browsing and traffic data of the Site, as well as, where applicable and subject to your consent, data collected for advertising and statistical purposes).

3. Why do we collect this Data?

We process your Data only on the basis of legitimate grounds, among those clearly identified below, or on the basis of your consent:

your first and last name as well as, if applicable, the name of the company you represent, in order to process your requests, prepare a quotation and organise the services you book. This Data is necessary for the performance of the contract or for pre-contractual measures;
your email address and telephone number in order to enable us to get in touch with you. This Data is necessary in the context of providing the services. When used to send you our newsletter or any other advertising communication, such use is based on your consent;
the information you provide to us in the context of the preparation and performance of the services, in order to personalise them and provide you with tailored advice. This Data is necessary for the performance of the contract;
the Data transmitted by the Site’s cookies in order to ensure its proper functioning and security (consent management, memorisation of the chosen language, protection of the contact form against automated submissions) as well as for page view counting purposes. This Data is processed on the basis of our legitimate interest in the proper functioning and improvement of the Site, and with your consent where required by applicable law;
all Data transmitted may be processed in order to comply with our legal obligations and other legal requirements.

For all cases where the above-mentioned grounds cannot be considered a legitimate basis, you consent to the processing of the Data for the purposes described above by approving this Policy.

Additional data that does not allow you to be identified, including in aggregated or anonymised form, may be used to manage the services, improve client relations, diagnose and manage technical issues and obtain demographic data in aggregated form.

4. With whom may we share your Data?

Suzana Pimenta may share your Data in the following manner:

to any third party to whom we are required to disclose such Data following an order issued by a judicial or governmental authority or in accordance with our legal obligations;
to any third party whose involvement is necessary for the proper performance of the services (for example our potential auxiliaries and partners, our hosting provider, our IT service providers or our fiduciary, as well as Google with respect to the reCAPTCHA service);
in the context of any transfer, restructuring or handover of the business in any form whatsoever, as well as in the event of possible bankruptcy proceedings, your Data could be transferred to third parties as a business asset. In such event, we will endeavour to the fullest extent possible to inform you of such transfers before they take place, but without being able to guarantee that you will have the opportunity to object to such a transfer.

Online courses: if you purchase an online course presented on the Site, your order is placed directly with the Hotmart platform, which collects and processes your Data (including your payment data) in its capacity as a separate data controller, in accordance with its own privacy policy available at www.hotmart.com. Only the terms and conditions and the privacy policy of Hotmart apply to such processing. Hotmart may communicate to us the information necessary for the follow-up of enrolments and the delivery of course content.

In certain circumstances, in particular for technical or functional reasons, or in the context of relationships with our subcontractors, your Data may be transferred outside Switzerland or the European Union. In such case, the third parties to whom the Data is transferred provide sufficient guarantees as to the implementation of appropriate technical and organisational measures so that the processing meets the legal requirements and ensures the protection of your rights.

By accessing the Site and providing us with Data, you expressly agree to such transfers.

5. Where is your Data hosted?

The Data collected by Suzana Pimenta is hosted by INFOMANIAK NETWORK SA, whose servers are located in Switzerland.

6. How do we process your Data?

We may process your Data by automated or non-automated means and, in all cases, take appropriate security measures.

We process your Data in compliance with applicable law, in particular Swiss data protection law, and adopt appropriate security measures to prevent unauthorised access, disclosure, modification, alteration or destruction of your Data.
